Executive Sessions

Executive or closed work sessions are defined as meetings limited to the members of the Board and such other persons as are specifically invited to attend. They may be held in the following instances:

  1. Conference with the Board's attorney, or certain other designated state or county officials or officers of the law on threats to (a) the security of public or private property, and/or (b) the public's right to access;
  2. Matters relating to (a) appointment, employment or dismissal and/or (b)complaints or charges against personnel;
  3. Matters relating to litigation or proposed litigation in which the Board is a party;
  4. Matters of national security;
  5. Consideration of the selection or purchase of real estate;
  6. Consideration of the acceptance of gifts, bequests, or donations where confidentiality has been requested by the donor;
  7. Consideration of receipt of lawfully confidential information;
  8. Consideration of accepting or tendering wages, benefits, or terms of employment during all negotiations;
  9. Consideration of suspensions, expulsions, or disciplinary action inconnection with a student.

The only persons who may attend executive sessions are Board Members, the superintendent (except when his appointment or salary are under consideration), and other individuals the Board may invite to be present.

Any decision discussed and deliberated upon during an executive session shall be formally acted upon at an open meeting following the executive session.

No action shall be taken at executive sessions. Minutes of executive sessions shall be recorded but not published. Minutes of executives session shall be maintained in confidential files of the District not open to the public. That such a session will be, or was held, shall be recorded in the minutes of the preceding or subsequent open meeting.

Board members and other persons attending an executive session are duty-bound not to disclose matters discussed at the executive session.
